General Terms

1.Definitions

In these terms, the following definitions apply:

• Consumer: a natural person who does not act in the exercise of a profession or business and enters into an agreement with El Gummo;
• Entrepreneur: El Gummo;
• Distance agreement: an agreement whereby products or services are concluded exclusively through a communication technique at a distance;
• Durable data carrier: a means by which the consumer can store information personally and consult it later;
• Right of withdrawal: the right to dissolve the agreement within the reflection period.

3. Applicability

These general terms and conditions apply to every offer and every agreement between the consumer and El Gummo. Prior to concluding an agreement, these terms will be made available.

4. The offer

The offer is non-binding and can be changed. It contains a clear description of products, prices including VAT, shipping costs, and other relevant information.

 

 

5.Formation of the agreement

The agreement is concluded as soon as the consumer accepts the offer and has made the payment. Upon receipt of the order, El Gummo confirms this by email.

6. Right of withdrawal

Consumers have the right to cancel the purchase within 14 days of receipt without giving any reason. The reflection period starts the day after receipt. Products must be returned undamaged and in their original packaging.

7. Costs of withdrawal

Return costs are the responsibility of the consumer. El Gummo will refund the amount paid within 14 days after receiving the returned product.

8.Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

• Products that are custom-made;
• Products that cannot be returned due to their nature;
• Sealed hygiene products whose seal has been broken.

9. Prices

Prices are inclusive of VAT and exclusive of shipping costs unless stated otherwise. Price changes will be clearly indicated.

10. Conformity and warranty

El Gummo guarantees that products comply with the agreement and legal requirements. Complaints about defects must be reported within 14 days of receipt.

11. Delivery

El Gummo delivers orders within 30 days, unless otherwise stated. In case of delay, the consumer will be informed and the order can be canceled free of charge.

12. Payment

Payment must be made within 7 days after ordering, unless otherwise agreed.

13. Complaints

Complaints about products or services can be reported in writing within 7 days of discovery via info@elgummo.nl of or by phone at 06 15326732. El Gummo will respond within 14 days. If it is not possible to reach a solution together, the consumer can turn to an independent disputes committee or the court.

14. Disputes

Dutch law applies to agreements.Disputes can be submitted to the competent court.

You have the right to access, correction, deletion, restriction of processing, data portability, and the right to object. You can also withdraw your consent.
